Terms of Service

These terms are an agreement between you and Blufish LLC, which operates Plantistry ("Plantistry", "we", "us"). By creating an account or using plantistrylabs.com, you accept them. If you do not accept them, do not use the service.
1. The service
Plantistry is software for tracking plant collections, breeding programs, tissue culture work, and experiments, together with a marketplace where members can buy, sell, and trade plants, equipment, and growing protocols. We provide the software and the venue. Except for digital protocols we publish ourselves, we are not the seller of items listed on the marketplace.
2. Your account
You must provide accurate information and keep your password secure. You are responsible for activity under your account. You must be at least 16 years old. We may suspend or close accounts that violate these terms, abuse other members, or create risk for the service.
3. Your content and data
Your records, photos, and other content remain yours. You grant us the license needed to store, process, and display them in order to run the service. Content you publish to the marketplace or send in messages is visible to its intended audience. We do not sell your data. See the Privacy Policy for details, including how to delete your account and data.
4. Subscriptions and billing
- The free tier is free, with the feature limits shown on the pricing page.
- Pro is billed in advance, monthly or yearly, through Stripe. Prices are shown before you subscribe. We may change prices with notice; changes apply at your next renewal.
- You can cancel at any time. Your subscription stays active until the end of the period you paid for, then your account moves to the free tier. Your data is kept.
- Payments are not refundable, in whole or in part, including for unused time, except where the law requires otherwise.
- If a renewal payment fails and is not resolved, Pro features are suspended until payment succeeds.
5. Marketplace
Sellers on the marketplace are independent of Plantistry. When you buy from a seller, the contract of sale is between you and that seller. Payments are processed by Stripe; seller proceeds go to the seller, and Plantistry keeps a platform fee that is disclosed to sellers before they list.
- Sellers are responsible for the accuracy of their listings, the health and identity of their plants, packing and shipping, complying with all laws that apply to their sales, and their own taxes on income from sales.
- Buyers are responsible for knowing whether they can legally receive what they order in their location.
- Trades are arranged directly between members. Plantistry records the agreement and introduces the parties, but the exchange itself, including shipping and the condition of traded material, is between the traders at their own risk.
- Offers accepted by a seller become binding at the agreed price once the buyer completes payment.
- We may remove listings and restrict marketplace access at our discretion, including for the prohibited items below.
6. Prohibited items and conduct
You may not list or trade:
- Plants or plant material whose sale or movement is restricted by law, including CITES-listed species without required documentation, protected native species collected from the wild, and noxious or invasive species where prohibited.
- Plant material that requires phytosanitary certification or permits you do not have. Interstate and international shipment of live plants is regulated; complying with USDA, state agriculture, and destination-country rules is the seller's responsibility.
- Controlled substances, or plants or fungi whose cultivation is illegal in the buyer's or seller's jurisdiction.
- Spores, spore prints, syringes, or cultures of psilocybin-containing mushroom species. Several U.S. states prohibit even the spores of these species, and cultivating them is a federal offense; such listings are removed and may lead to account termination. For all other fungi, verifying that a listing is legal to sell and ship to the buyer's location is the seller's responsibility.
- Anything misrepresented, stolen, or infringing someone else's rights.
You also may not scrape the service, interfere with its operation, harass other members, or use the marketplace to move payments unrelated to plants and growing.
7. Taxes
Where marketplace facilitator laws require it, Plantistry collects and remits sales tax on marketplace transactions. Where tax on subscriptions applies, it is added at checkout. Sellers are responsible for income taxes on their proceeds and for any tax obligations arising from sales made outside the platform.
8. Protocols and digital goods
Purchased protocols are licensed for your own use. You may adapt them for your work; you may not resell or republish a purchased protocol as your own. Sellers who publish protocols confirm the content is theirs to sell. Results depend on your material and conditions; no outcome is guaranteed.
9. Disclaimers
The service is provided as is. We do not warrant that it will be uninterrupted or error free, that stored data can never be lost (keep your own exports of anything critical), or that any plant, protocol, or piece of equipment bought through the marketplace will perform as described. Nothing in the service is legal, financial, or horticultural advice.
10. Limitation of liability
To the fullest extent the law allows, our total liability for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or losses arising from transactions between members.
11. Changes
We may update these terms as the service evolves. For material changes we will give notice in the app or by email before they take effect. Continuing to use the service after that means you accept the updated terms.
